DeepSeek MiniMax open source China AI export analysis

The useful word here is not ban. It is registration. For AI teams shipping from China, or building on Chinese open models abroad, the emerging question is less whether a model can leave the country and more which release path needs to pass through a ministry form first. That is not quite the same thing, and lawyers tend to notice the difference before product teams do.

DeepSeek and MiniMax have reportedly become the first test cases. Their registrations arrive as China considers adding 23 AI technologies, including large models, agents, compute clusters and information processing, to its technology export control catalogue. The practical lesson is familiar: export control can become release infrastructure.

The registration layer arrives before the final list

China’s Ministry of Commerce said the Ministry of Commerce and the Ministry of Science and Technology issued Announcement No. 48 on 16 October 2026, opening public comment on revisions to the Catalogue of Technologies Prohibited or Restricted From Export and applying temporary pre export registration for covered technologies. The ministry said the proposal spans 40 key technologies in AI, biomedicine and photovoltaics, with 14 proposed for prohibition and 26 proposed for restriction. It also said 23 AI technologies would be added, covering areas such as large models, agents, compute clusters and information processing.

Pandaily reported that the disclosure on DeepSeek and MiniMax came on the evening of October 22 from Yuyuan Tantian, an account run by China Media Group. Pandaily also reported, citing Huxiu, that DeepSeek made DeepInfer and deepseek-recipe open source on October 20. Reuters, as carried by Central Oregon Daily, reported that MiniMax said on October 23 it had completed technology export registration with China’s commerce ministry for open-source release and overseas licensing of “certain recently released and upcoming models.”

This is the part to read carefully: registration is not the final catalogue, and it is not automatically a restrictive license. Pandaily described the catalogue as still a consultation draft, which is the correct compliance posture. Treat the current regime as an interim gate, not as settled law with all edge cases ironed out.

What China says counts as an AI technology export

MOFCOM’s answer gives builders the operational dividing line. Until the formal revised catalogue is implemented, technology export operators must register before exporting technologies listed in the announcement through the ministry’s business system platform. The ministry said companies must judge for themselves whether their planned export falls into the temporary registration scope, which is lawyer language for: document your reasoning before you ship.

The ministry listed the kinds of transactions that need registration: transferring technology ownership abroad, authorizing overseas use of domestic technology, changing the owner or actual controller of domestic technology to an overseas entity, and other situations specifically required by MOFCOM. It also said already started but unfinished exports are covered if they fall within the registration scope. That matters for licensing deals signed before the product team discovered the policy memo.

Just as important, MOFCOM drew boundaries around what is not treated as a large model technology export. Overseas local deployment of restricted AI technology falls within export management, according to the ministry. But API access, app or web interaction, SaaS use and lightweight edge deployment using restricted large models are not treated as large model technology exports under that explanation. Your deployment architecture is now a compliance fact pattern.

Open source is allowed, but not frictionless

MOFCOM said the revision is ordinary technology trade management and “does not target any specific country, region or entity.” It also said open sourcing AI technology, Chinese firms building and operating their own overseas compute centers, overseas chip tape out, joint research using overseas resources and international standards work may qualify for automatic license convenience measures. Technologies already public through open source or academic papers are proposed to sit outside export management.

That does not mean every repository push is magically exempt. TNW quoted Yuyuan Tantian as saying DeepSeek and MiniMax completed registration and obtained open-source and overseas licensing rights, while also noting it had not independently verified the post. For MiniMax, Reuters reported a company statement confirming completed registration for open-source release and overseas licensing of certain models, which is stronger evidence than a reposted policy victory lap.

The MiniMax structure also shows where model openness meets territorial licensing. Pandaily reported that MiniMax created a formal application route for regions previously excluded under an earlier model license, including the United States, the European Union, the United Kingdom and South Korea. Under that setup, the weights stay open, but organizations in those regions must pass a compliance review and obtain a license before local deployment.

What builders should do next

The immediate task is not to rewrite every roadmap around a hypothetical total export stop. MOFCOM’s own explanation points to a narrower question: are you exporting restricted technology, or are you providing a service interface that stays outside large model technology export management. That distinction should appear in release notes, licensing records, customer contracts and deployment diagrams, not just in a Slack thread named legal.

For teams using Chinese open models abroad, the next checkpoint is the final catalogue text. Watch whether the treatment of local deployment, open source releases, overseas compute centers and automatic license channels survives the consultation process intact. If it does, China’s AI export regime will look less like a wall and more like a filing system that sits between model release and overseas commercialization. Annoying, yes. Ignorable, no.
